Reflective Tape on Traffic Cones: What MUTCD Requires and How to Stop Buying Fakes
Avoiding fake retroreflective tape is not a visual-inspection problem. It is a documentation problem. There is no federal definition of "counterfeit" retroreflective sheeting in the US. What you can enforce is three things: the specification the tape has to meet, the correct sheeting type for a cone (ASTM D4956 Type VI with a Class 5 non-adhesive backing), and the certification chain that must be completed before the product is incorporated into the project.
What the MUTCD actually requires on a cone
The current edition is the MUTCD 11th Edition with Revision 1, adopted by Final Rule with an effective date of March 5, 2026. Cones are covered by Section 6K.03, not Section 6F.64. Chapter 6 was renumbered in the 11th Edition, and most pages you will find online still cite the old clause number from the 2009 edition.
Section 6K.03, paragraph 01 (Standard):
"Cones (see Figure 6K-1) shall be predominantly orange and shall be made of a material that can be struck without causing damage to the impacting vehicle. For daytime and low-speed roadways, cones shall be not less than 18 inches in height. When cones are used on freeways and other high-speed highways or at night on all highways, or when more conspicuous guidance is needed, cones shall be a minimum of 28 inches in height."
Section 6K.03, paragraph 02 (Standard), the band layout the tape has to satisfy:
"For nighttime use, cones shall be retroreflectorized or equipped with lighting devices for maximum visibility. Retroreflectorization of cones that are 28 to 36 inches in height shall be provided by a 6-inch wide white band located 3 to 4 inches from the top of the cone and an additional 4-inch wide white band located approximately 2 inches below the 6-inch band."
Section 6K.03, paragraph 03 (Standard), cones taller than 36 inches:
"Retroreflectorization of cones that are more than 36 inches in height shall be provided by horizontal, circumferential, alternating orange and white retroreflective stripes that are 4 to 6 inches wide. Each cone shall have a minimum of two orange and two white stripes with the top stripe being orange. Any non-retroreflective spaces between the retroreflective stripes shall not exceed 3 inches in width."
Why this matters when you are checking tape: a cone that is non-compliant usually fails on the band geometry before it fails on the tape itself. Wrong band width, wrong distance from the top, or more than 3 inches of non-retroreflective gap on a large cone. Measure the cone, not the tape.
Which sheeting type a cone is supposed to use
ASTM D4956 is the US specification for retroreflective sheeting. The current edition is ASTM D4956-26; the previous edition was D4956-19. Its scope covers "flexible, non-exposed glass-bead lens and microprismatic, retroreflective sheeting designed for use on traffic control signs, delineators, barricades, and other devices."
MUTCD Table 2A-3 cites ASTM D4956-04 and lists the types as I, II, III (beaded) and III, IV, VI, VII, VIII, IX, X (prismatic). FHWA adds Type XI in its sign-retroreflectivity FAQ, noting that ASTM D4956 "currently includes nine classifications or types of materials, and AASHTO M268 includes four types."
For cones specifically, the type assignment is Type VI, and the backing class is Class 5. Both are stated in an FHWA-developed sheeting identification guide:
"Type VI -- An elastomeric high-intensity retroreflective sheeting without adhesive. This sheeting is typically a vinyl microprismatic retroreflective material. This sheeting is typically used for orange temporary roll-up warning signs, traffic cone collars, and post bands."
"Class 5 -- This shall be a nonadhesive backing made of material commercially used for self-supporting products such as traffic cones, temporary roll-up warning signs, and post bands."
The practical takeaway: if a supplier describes cone tape only as "high intensity reflective" or "engineering grade" without naming a D4956 type, you cannot tell whether it is the right material for a cone collar. Ask for the type.
The official field method to identify sheeting, and its limit
FHWA publishes the 2014 Traffic Sign Retroreflective Sheeting Identification Guide (publication number FHWA-SA-14-022). Its method is genuinely useful and genuinely limited:
"Many sign sheeting materials have watermarks and/or patterns that are used to identify the material type and manufacturer. The watermarks shown in this guide have been enhanced. The watermarks will be less visible in practice and may not be present on smaller pieces of sheeting due to the spacing."
You compare the watermark or embossed pattern against the guide's actual-size photographs, then read off the ASTM D4956 and AASHTO M268 designation from the guide's tables.
Now the limit, in FHWA's own words:
"This document is intended to help identify sign sheeting materials for rigid signs and their common specification designations. It is not a qualified product list. FHWA does not endorse or approve sign sheeting materials. Many other sheeting materials not listed here are available for delineation and construction/work zone uses."
And on glass-bead material specifically, the underlying guide states plainly that Type I sheeting has "a uniform appearance without any pattern or identifying marks" and "is indistinguishable from grades lower in reflectivity and durability such as 'utility' and 'commercial' grade."
So watermark matching can confirm what a material claims to be. It cannot prove that a material is not a lower grade sold as a higher one.
If there is no federal definition of "counterfeit", what do you actually enforce?
This is the part most supplier pages get wrong. There is no official US federal statement defining, describing, or giving field instructions for "counterfeit" or "re-marked" retroreflective sheeting. What exists instead is a chain of procedural controls on federal-aid projects, and that chain is what protects you:

Two named acceptance routes appear in state DOT practice, and it is worth knowing which one your product sits under:
"Approved Products. Products which can be accepted based upon a manufacturer's representation that a product complies with all contract requirements, usually identified by a product name. Common examples are ... sign sheeting."
"Certified Products. Products which can be accepted based upon a manufacturer's certificate of compliance."
And FHWA's own procurement advice:
"Additionally, it is important to have procurement processes that ensure that sign materials are being specified that offer retroreflectivity performance that meets or exceeds the minimum levels specified in the MUTCD."
Translation for a buyer: the defence against fake tape is a certificate of compliance naming the D4956 type and the production lot, plus a test report from a qualified laboratory. Not a torch and a squint in the yard.
Three things the internet says about cone tape that are not in the MUTCD
This is where most competing pages get it wrong, so it is worth being precise.
- "18 inches up to 40 mph, 28 inches above 45 mph." No MUTCD table ties cone height to a posted speed limit. Section 6K.03 paragraph 01 uses qualitative categories only: "daytime and low-speed roadways" against "freeways and other high-speed highways or at night on all highways." If a table with numeric speed thresholds is presented as MUTCD text, it is not.
- "Section 6F.64 is the cone clause." That was the 2009 edition. In the 11th Edition the cone clause is Section 6K.03. FHWA also stopped publishing the MUTCD in HTML from the 11th Edition onward, so only the PDF is official. HTML pages citing 6F.64 are quoting a superseded edition.
- "Complies with ASTM D4956" as a complete statement. The specification works by type. A datasheet that does not name the type and the backing class does not tell you whether the material is the right one for a cone collar.
Pre-purchase checklist for US buyers
- Does the certificate name the ASTM D4956 type (for cone collars, Type VI) and the backing class (Class 5)?
- Does the test report come from a qualified laboratory in the sense of 23 CFR 637.209?
- Can the supplier trace the sheet back to a production lot?
- On a 28 to 36 inch cone: is there a 6-inch white band, 3 to 4 inches from the top, plus a 4-inch white band about 2 inches below it?
- On a cone over 36 inches: are there at least two orange and two white stripes, 4 to 6 inches wide, top stripe orange, with no gap over 3 inches?
- Is the retroreflective material's outer surface smooth and sealed, so it shows a similar colour day or night?
- For a federally funded project: is the Buy America certification in place before the product is incorporated, and does the supply chain provide step certification?
FAQ
Do traffic cones in the US have to be retroreflectorized?
For nighttime use, yes. MUTCD Section 6K.03 paragraph 02 states that cones "shall be retroreflectorized or equipped with lighting devices for maximum visibility."
Which ASTM D4956 type applies to traffic cone collars?
Type VI, with a Class 5 non-adhesive backing, according to the FHWA-developed sheeting identification guide, which lists "traffic cone collars" as a typical Type VI application.
Can I identify a fake reflective collar by looking at its watermark?
Partly. FHWA's sheeting identification guide lets you match a watermark or pattern to a material type and manufacturer, but the guide states it "is not a qualified product list," and glass-bead Type I material is explicitly described as indistinguishable from lower utility and commercial grades.
Is there a federal definition of counterfeit reflective tape in the US?
No. No official US federal source defining or giving field instructions for counterfeit or re-marked retroreflective sheeting could be located. The enforceable control is the specification plus the certification chain on 23 CFR 637 Subpart B and the FHWA Buy America certification requirements.
